These Terms of Use ("Terms") govern your use of https://blondehairshampoo.com (the "Site"). The Site is operated by X Enterprises, LLC, 18122 3rd Dr SE, Bothell, WA 98012 ("we," "us," or "our"). By using the Site, you agree to these Terms. If you do not agree, do not use the Site.

What the Site is, and what it is not

The Site publishes general information about shampoos and conditioners for blonde, lightened, highlighted, and gray hair, including purple, blue, and other toning shampoos, product labels and ingredient lists, and using products as their labels direct. We are not a retailer, a brand, a maker, a salon, a cosmetologist, a testing laboratory, a government agency, a medical provider, or a lawyer. We do not sell shampoo, conditioner, hair color, or other products. The Site does not give prices, product picks, or hair coloring, bleaching, or lightening instructions.

Important hair and scalp product notice

Hair and scalp products, including shampoos, conditioners, toners, hair dyes, and lighteners, can cause skin or scalp irritation or allergic reactions in some people, and some can harm the eyes. Follow the directions and warnings on the label. Test a new product as its label or your doctor directs (any suggestion on the Site to test a shampoo first is our general suggestion, not a substitute for the label), keep products out of your eyes, and stop using a product if irritation occurs. If a product gets in your eyes, rinse them well with water, and get medical help if irritation does not go away. Keep products out of reach of children. Do not use the Site to diagnose or treat any condition, or to delay getting medical care. We do not say that any product or practice is safe or effective for you, that it will change the color, condition, or health of your hair or scalp, or that it will give any result.

Cosmetics, not drugs

Shampoos, conditioners, and toning shampoos discussed on the Site are described as cosmetics. Under U.S. law, a product intended to treat or prevent disease, or to affect the structure or any function of the body, is a drug, and some products are both. The Site does not say that any product repairs, heals, regrows, strengthens, or treats hair or the scalp, or that it prevents or stops hair loss or breakage. The Site does not say that any shampoo, conditioner, or other hair product protects hair or skin from the sun; products with sun protection claims can be drugs. Where the Site summarizes how the U.S. Food and Drug Administration (FDA) tells cosmetics and drugs apart, it does so as FDA states it, for general information only.

Toning, color, and lightening

Where the Site describes purple, blue, or other toning shampoos, hair color, or lighteners, it describes them in general terms and as their makers and FDA describe them. Where the Site gives FDA's hair dye steps, they are FDA's steps for hair dye, not for shampoo, toning shampoo, or lightener. Results vary by person, by hair, and by product. The Site does not give coloring, bleaching, or lightening instructions. Hair dyes and lighteners carry their own label cautions and directions, including any patch or skin test the label requires. Follow them, or use a licensed professional.

Ingredients, labels, and "free-from" claims

Ingredient names and label terms such as "sulfate-free," "paraben-free," "hypoallergenic," "natural," or "for color-treated hair" are the maker's descriptions, not ours. We do not say that any free-from claim makes a product safer, gentler, or better, or that any product is non-toxic. We do not verify any maker's ingredient, label, or performance claims.

Makers' labels, directions, and recalls

We are not responsible for any third party's products, claims, labels, or recalls. You can report a problem with a cosmetic product to FDA.

Indemnification

Dispute resolution; binding arbitration; class-action waiver

Please read this section carefully. Except for small-claims matters and claims for injunctive relief over intellectual property, any dispute about these Terms or the Site will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules. The seat of arbitration will be King County, Washington, unless you and we agree otherwise. You and we waive any right to a jury trial and to take part in a class, consolidated, or representative action. If the class-action waiver is found unenforceable for a claim, that claim must proceed in court and not in arbitration.

Governing law and venue

These Terms are governed by the laws of the State of Washington, without regard to conflict-of-law rules. Subject to the arbitration section, exclusive venue for permitted court actions is the state or federal courts in King County, Washington, and you consent to jurisdiction there.

Assignment and change of operator

We may assign or transfer these Terms, and the Site, to a successor operator, including as part of a sale of the Site, without notice to you. After that, the successor operator takes our place under these Terms and may post its own terms. You may not assign these Terms without our written consent.

Changes

We may update these Terms by posting a revised version on this page with a new "Last updated" date. Continued use after that date means you accept the revised Terms.

Miscellaneous

These Terms, with the Privacy Policy and Affiliate Disclosure, are the entire agreement between you and us about the Site. If any provision is unenforceable, the rest remain in effect. Our failure to enforce a provision is not a waiver.
